In the text the foreign minister says he is well aware of the case, noting that in October 2007 he met with the wives of the Cuban Five.
De Gucht notes that the detention of the Cubans, who were trying to gather information that would prevent terrorist attacks against their country, clearly falls under the UN Working Group's definition of arbitrary detention.
In May 2005, the UN group concluded that the imprisonment of Antonio Guerrero, Fernando Gonzalez, Gerardo Hernandez, Ramon Labañino and Rene Gonzalez, who have spent nearly a decade in US prisons, violates the International Convention on Political and Civil Rights and called for their immediate release.
Belgium supports the resolutions of the UN organizations that are asking the member states to take into account the recommendations of the UN Working Group on Arbitrary Detentions and take the measures necessary to rectify the situation of these persons who have been arbitrarily denied their freedom, said the foreign minister.
