The First District Court of Appeal in Florida has mandated the complete removal of a grand jury report that alleged $10 million from a Medicaid settlement was funneled into the Hope Florida Foundation and subsequently directed to political committees linked to Governor Ron DeSantis.

According to CBS News, the 19-page decision penned by Judge Lance Neff asserts that the settlement was lawful and criticizes the grand jury for overstepping its authority by publicly condemning individuals who were never formally charged.

The report, crafted by the Leon County Grand Jury, had labeled the operation as a "sophisticated scheme to fund political activities," yet acknowledged insufficient evidence to charge anyone.

Legal and Financial Nuances

The court clarified that the $10 million was never state money, emphasizing that the company Centene transferred the funds directly to the Hope Florida Foundation, bypassing Florida's state coffers.

"The funds did not reimburse the state for any losses due to Centene's overcharges nor did they become property of the state, as the transfer was directly from Centene to Hope Florida," the ruling states.

Controversial Distribution and Legal Oversight

The court further dismissed the grand jury's main contention that state law prohibits executive agencies from making agreements benefiting third parties. The ruling explained that this law was not applicable since the agreement with Centene was reached before any formal civil lawsuit was filed.

"This matter was resolved before any civil action was initiated. As no civil action had been commenced in a court, no judicial settlement had been reached," the judgment notes.

Moreover, the court condemned state prosecutor Jack Campbell for distributing the report to 49 recipients—including an unrelated party—prior to giving those affected the opportunity to challenge it, violating confidentiality laws.

"The prosecutor's error wasn't merely a failure to notify; it was the excessively broad handling of a confidential document, breaching confidentiality requirements before affected parties could be heard," the resolution concludes.

Political Implications and Reactions

Judge Neff, appointed to the court by DeSantis in March 2026, two months after the grand jury report was finalized, has not escaped scrutiny from critics.

Supporters of the governor hailed the decision as complete vindication. Jeremy Redfern, Deputy Chief of Staff for Attorney General James Uthmeier, triumphantly posted on X: "TOTAL AND COMPLETE VICTORY! The Hope Florida Fraud grand jury report was entirely erased by the 1st DCA of Florida."

The political ramifications are immediate. The grand jury report, leaked to the press in August 2026 and first obtained by CBS News Miami, had been a central argument for Democrats to tie the DeSantis administration to the political use of Medicaid funds.

This decision could weaken one of the Democrats' main campaign arguments against the DeSantis administration. With the report nullified, Democratic gubernatorial candidate David Jolly loses a significant tool just weeks before the general election on November 3.

Republican candidate Byron Donalds, endorsed by Donald Trump and running with Cuban-American Senator Bryan Ávila as his running mate, was leading Jolly by seven points in a Mason-Dixon poll released this week.

Key Questions on the Florida Court's Decision

Why was the grand jury report on Hope Florida deleted?

The report was deleted because the court found that the grand jury overstepped its authority by condemning individuals who were never charged and that the $10 million in question was never state money.

What was the significance of the grand jury report for the Democrats?

The report was a key argument for Democrats to link the DeSantis administration to the alleged misuse of Medicaid funds for political purposes, impacting their campaign strategy against DeSantis.

How does the deletion of the report affect the upcoming election?

With the report removed, Democratic candidate David Jolly loses a critical argument against DeSantis, potentially affecting his campaign less than a month before the general election.
