A coalition of 25 Democratic members of Congress has called upon Secretary of State, Marco Rubio, to clarify the potential involvement of the Trump administration in the escape of Brazilian Senator Flávio Bolsonaro to the United States. After leaving Brazil, despite a judicial order restricting his international travel, Bolsonaro arrived in Miami.

The legislators crafted a letter dated October 29, in which they posed 15 questions to the State Department. These inquiries aim to uncover who approved visas for the Brazilian politician and his family, when U.S. authorities became aware of the judicial restrictions, and whether American officials assisted in his departure, as reported by CNN Brazil.

Congress Demands Transparency

Rubio has been given until November 13, 2026, to provide written responses. Additionally, the lawmakers have requested that State Department officials be prepared to offer explanations to congressional staff.

This initiative was spearheaded by Representatives Sydney Kamlager-Dove from California and Dina Titus from Nevada, with the endorsement of 23 other Democratic legislators, including Greg Casar, Jasmine Crockett, Glenn F. Ivey, and Jonathan L. Jackson.

Investigating Diplomatic and Immigration Resources

The primary concern is to determine if U.S. diplomatic and immigration resources were utilized to aid a foreign politician in circumventing his country's legal constraints. The letter asserts that both Congress and the American public have a vested interest in overseeing government actions in situations involving foreign judicial proceedings and sensitive diplomatic relations.

The central questions focus on whether the State Department, the U.S. Embassy in Brazil, or any federal agency facilitated Bolsonaro's travel or entry into the United States despite the restrictions imposed by Brazil's Supreme Court.

Scrutinizing Visa Authorization

The Democrats are seeking information on who authorized the visas, the timing of the decision, and whether the U.S. government verified Bolsonaro's legal ability to leave Brazil. They are also inquiring if any Washington official reviewed or discussed the judicial order before the senator's departure and whether authorities were aware of his failure to surrender his passports as required.

Additional questions target the White House, requesting details about any potential contacts between U.S. officials and Bolsonaro, his family, lawyers, political advisors, or intermediaries to coordinate his journey. The document also queries whether assistance was provided for securing transportation, organizing flights, managing immigration paperwork, scheduling consular appointments, or facilitating airport access.

International Coordination and Diplomatic Consequences

The letter seeks to clarify if the State Department coordinated actions with the Department of Homeland Security (DHS), Customs and Border Protection (CBP), Citizenship and Immigration Services (USCIS), or other federal agencies. It also extends its inquiries to Argentina and Ecuador, countries Bolsonaro passed through before reaching Florida, asking if U.S. officials stationed there were involved in coordinating his itinerary.

The congress members also demand to know whether Washington assessed the diplomatic repercussions of allowing a politician under judicial investigation in Brazil to enter the country and if the Department of Justice was consulted regarding legal implications.

Accusations and Political Implications

The letter stops short of formally accusing Rubio of orchestrating the senator's departure but insists on identifying any officials who might have been involved, the nature of their assistance, and the authority under which they acted. This demand follows reports of possible involvement by Marco Rubio in Bolsonaro's escape to the United States.

On October 27, businessman Jason Miller shared claims about alleged efforts by the Secretary of State to facilitate the trip. However, those allegations did not demonstrate that Rubio personally directed the operation.

On the same day, American and Brazilian media reported that the Trump administration had decided to grant visas to Bolsonaro and his family. Subsequently, Donald Trump publicly supported the Brazilian senator's entry into the U.S. and questioned Brazil's presidential election results, despite not providing evidence of electoral fraud.

When asked if he would allow the politician and his family to enter, Trump responded affirmatively, describing them as "good people."

Flávio Bolsonaro arrived in Miami on a Wednesday, accompanied by his wife and two daughters, after leaving Brazil overland to Argentina and continuing on a private jet that stopped in Guayaquil, Ecuador. According to reports about his arrival at Opa-locka Executive Airport, the senator used an Italian passport to cross the border after Brazilian authorities demanded the surrender of his travel documents.

The travel restriction was imposed by Justice Alexandre de Moraes of Brazil's Supreme Court as part of investigations into alleged money laundering and other financial irregularities.

The senator had recently lost the presidential election runoff to Luiz Inácio Lula da Silva by approximately 4.4 million votes. Following his defeat, Bolsonaro alleged electoral fraud and initially refused to concede to Lula's victory, though he did not provide evidence supporting his claims.

Once in the U.S., Bolsonaro went on to declare himself the "elected president" of Brazil in a message on social media, although he later revised that statement to position himself as a political leader of the opposition.
