Argentina: Prosecutors Seek to Seize Over $5 Million from Cristina Kirchner's Daughter

Argentinian prosecutors have requested the seizure of more than $5 million held in the name of Florencia Kirchner, daughter of former President Cristina Fernández de Kirchner. This move follows confirmation from Banco Galicia that the funds, frozen for a decade, remain accessible to the judicial system.

Banco Galicia's revelation to the Argentine judiciary regarding the availability of this substantial sum has led prosecutors Diego Luciani and Sergio Mola to push for these funds to be included in the asset seizure process of the Vialidad case. Cristina Kirchner is currently serving a six-year prison sentence, upheld by the Supreme Court in June 2025.

The funds were initially seized in 2016 by Judge Julián Ercolini during the investigation of the Hotesur-Los Sauces case, which looks into alleged money laundering through the Kirchner family's hotels in Patagonia.

The money is comprised of $4,664,000 found in a safety deposit box, along with $1,032,144 and 53,280 pesos across two savings accounts. Delays by the bank in responding to judicial requests had caused concern among the courts, but the institution confirmed last Monday that the funds are indeed available.

This sum is part of a second block of assets under review by the Federal Oral Court 2 (TOF 2), which also includes 13 properties belonging to the Kirchner family and 128 real estate assets tied to businessman Lázaro Báez. A first block of 111 properties—84 of which belong to Báez, 19 to Máximo and Florencia Kirchner, and one to the former president—has already been seized by TOF 2, with the Federal Chamber of Cassation upholding the decision, although appeals have been made to the Supreme Court.

The total amount that needs to be recovered in the Vialidad case has been adjusted for inflation from the original 84.835 billion pesos to 684.990 billion pesos (over $450 million USD). None of those convicted have voluntarily deposited this sum within the ten-business-day deadline set by the court.

Although Florencia Kirchner was acquitted in the Hotesur-Los Sauces case, her funds remain frozen as the origin of the money is still under scrutiny. This introduces a potential conflict: Federal Oral Court 5, which is handling the Hotesur-Los Sauces case and held its first preparatory hearing last week, might contest TOF 2's authority to allocate these funds for the Vialidad seizures as they remain tied up in the ongoing proceedings.

This case exemplifies the corruption patterns seen within the so-called "21st-century socialism" in Latin America. The Kirchners have maintained close ties with Cuba and Venezuela, and the United States sanctioned Cristina Kirchner in March 2025 due to corruption allegations. Other leaders within the regional bloc have faced legal repercussions as well: Rafael Correa received an eight-year prison sentence in Ecuador in 2020 for the Sobornos case, and Lula da Silva faced charges in Brazil under the Lava Jato investigation, though these were annulled by Brazil's Supreme Court in 2021 on procedural grounds.

The Argentine Supreme Court still needs to decide whether any of the properties from the first block will be allocated for use by the judiciary, a necessary step before the court can proceed with the definitive execution of the seizure.
