Cuban Court Upholds 14 and 13-Year Sentences for Political Prisoners Ana Ibis Tristá Padilla and Jarol Varona Agüero

The Cuban judicial system has confirmed the 14 and 13-year prison sentences handed down to political prisoners Ana Ibis Tristá Padilla and Jarol Varona Agüero, as reported by Cubalex, through a cassation appeal.

These sentences, initially issued in September 2025 by the State Security Offenses Court of the Provincial Tribunal of Santiago de Cuba, are now final with all avenues for appeal exhausted.

Ana Ibis is serving her sentence at the Women's Prison of Las Tunas, also known as La Veguita, while Jarol Varona is held at the Provincial Prison of Las Tunas, commonly referred to as El Típico.

The Repressive Use of Legal Processes

This case highlights how the legal apparatus is wielded as a tool of repression. Both individuals were arrested in connection with a peaceful march planned for May 14, 2023, in Las Tunas' Vicente García Park, which never took place. Ana Ibis, aged 37, was detained on November 7, 2023, charged as the lead organizer of the demonstration, for placing political posters, and plotting to use Molotov cocktails.

During a first trial in November 2024, the Santiago de Cuba Provincial People's Court acquitted both due to insufficient evidence, acknowledging a lack of material proof against them. Ana Ibis remarked to Martí Noticias upon learning of the verdict, "I find it truly unbelievable. The ruling states that both Jarol and I are acquitted due to a lack of evidence."

Nonetheless, the Prosecutor's Office appealed the acquittal, and the Supreme Court overturned it in May 2025, ordering a retrial. In this second hearing, also held in Santiago de Cuba—where special courts for State Security cases operate, despite the accused living in Las Tunas—sentences were issued: 14 years for Ana Ibis for "propaganda against the constitutional order" and "other acts against state security," and 13 years for Jarol Varona on similar charges.

Personal and Political Context

Ana Ibis is married to fellow political prisoner Damián Hechavarría Labrada, who, on April 21, 2021, was one of the first to document the use of the slogan "Down with the dictatorship! Homeland and Life!" in Cuba, months before the July 11 protests. Damián was sentenced to five years in prison. Since then, Ana Ibis has emerged as a public activist and advocate for political prisoners, making her a target for the regime.

Others were convicted in the same case, including Félix Daniel Pérez Ruiz, who received a five-year sentence, and Christian de Jesús Peña Aguilera, sentenced to four years for sharing a Facebook post about the march.

International Condemnation and Health Concerns

The Cuban Observatory for Human Rights (OCDH) condemned the proceedings as "a political operation disguised as a judicial process," noting that "everything is based on reports and interpretations by the Ministry of the Interior and Counterintelligence, institutions directly involved in the repression." Cubalex also pointed out that the case "demonstrates the use of the criminal justice system to criminalize the exercise of fundamental rights, particularly freedom of expression and peaceful protest."

Ana Ibis' situation is particularly dire. In April 2026, the OCDH reported that the Cuban political prisoner was in severe health condition, suffering from kidney issues, extreme weakness, fainting, and physical deterioration due to lack of nourishment and medical care.

Cubalex has called for "the immediate and unconditional release of Ana Ibis Tristá Padilla, Jarol Varona Agüero, and all individuals imprisoned for political reasons in Cuba."
