This past Wednesday, the Provincial Court of the Balearic Islands held a preliminary hearing for the trial of three Cuban citizens accused of a group sexual assault on a 19-year-old Dutch tourist in a hotel room in Playa de Palma. The incident took place during the summer of 2021.

According to the indictment, the events unfolded in the early hours of August 9, 2021. The three defendants, who were vacationing in Mallorca, met three Dutch women of the same age while socializing at several bars and nightclubs in Playa de Palma.

The prosecution notes that one of the women engaged in consensual sexual relations with one of the men. However, around 4:30 AM, the other two friends returned to their accommodation, inadvertently taking the victim's mobile phone and leaving her alone with the three accused.
Upon realizing her friends had left, the young woman locked herself in the bathroom out of fear. It was there, the prosecution alleges, that one of the accused entered, forcibly kissed her, and initiated the sexual assault. According to the prosecution's account, the other two men subsequently joined in the attack.

The young woman was urgently taken to Son Llàtzer University Hospital, a public hospital in Palma de Mallorca, where doctors documented multiple bruises on her arms, legs, and hip.
She received immediate medical care, including biological sample collection to rule out sexually transmitted infections and preventive treatment for HIV.
The prosecution asserts that since the incident, the victim has suffered from post-traumatic stress disorder, requiring ongoing psychological and psychiatric treatment since 2021. Her symptoms include recurring nightmares, anxiety, and severe concentration difficulties.
Legal Proceedings Continue
Classified as a continuous sexual abuse offense, the charges are based on the law existing at the time of the alleged assault, prior to the 2022 reform of the Spanish Penal Code known as the "only yes means yes" law.
With no agreement reached during the preliminary hearing, the judicial process will move forward to a trial, with the date still pending from the Provincial Court of the Balearic Islands.
