These substances, colloquially known as "chemicals," are becoming increasingly prevalent, particularly in Havana.

The announcement, released on Tuesday by the Supreme Court, warns that these substances can be consumed through cigarettes or sprayed onto paper, even in minimal amounts, potentially leading to seizures, heart attacks, psychosis, or even death, as highlighted by experts from the Central Criminalistics Laboratory. This new legal directive aims to provide clearer judicial guidance in response to the rising cases.

Addressing Drug Trafficking with Stricter Measures

The Cuban Penal Code stipulates the application of Section 2, subsection g) of Article 235 for drug trafficking cases involving "relatively large quantities." Historically, this has been interpreted as one pound (460 grams). However, this standard will not apply to synthetic cannabinoids due to their extreme toxicity and addictive nature, which makes even small doses highly dangerous.

For these cases, additional factors must be considered, such as the specific type of substance, its purity, the number of doses it can produce, and the potential health impact. This necessitates forensic evidence from specialized toxicology and criminalistics laboratories. Authorities may also examine potential financial gains for the accused, the location of the offense, and whether it occurred in a drug-prone area.

Penalties for Unauthorized Possession

Individuals found in possession of synthetic cannabinoids without medical justification will face charges under Article 236, subsection a), with penalties ranging from one to three years in prison or fines, akin to those for potent drugs like cocaine. This initiative aims to close legal loopholes and enforce more accurate penalties as synthetic drugs become a growing public health and security challenge in Cuba.

The Harsh Reality and Institutional Limitations

Despite legal measures and official rhetoric, drug use and trafficking in Cuba appear to be beyond the regime's control. While the state endeavors to showcase exemplary actions and reforms, the widespread availability of synthetic substances and the erosion of social structures are overwhelming their response capacity. Recently, a case surfaced involving an entire family operating a drug trafficking network in Havana with complete impunity. Parents, children, and relatives worked in concert, highlighting a troubling normalization of crime within domestic and community settings.

The human toll is evident in the faces of those suffering directly from consumption. A young Cuban woman went viral after sharing images of the damage caused by these "chemicals," her face visibly marred. Her testimony on social media starkly contrasts with the official narrative, revealing the physical and mental deterioration inflicted by synthetic cannabinoids.

In response to this crisis, authorities announced the launch of a National Observatory for the Early Warning System on drugs.
