Jesús Novo explained that previously, if a Cuban national received a deportation order and Cuba did not accept them, they could be released under a "supervision order" once they served any criminal sentences until Cuba agreed to take them back. This situation has shifted, as noted by lawyer Wilfredo Allen, who advised Chocolate to voluntarily return to Cuba promptly to avoid ending up in a third country.

"Things have changed somewhat because the U.S. government has made agreements with other nations to accept deportees from third countries," Novo stated, suggesting this could be a potential destination for Chocolate. "Another option is the Guantanamo Naval Base, where some deportees with criminal orders are being sent," he added. Despite past refusals, Novo indicated Cuba might now be willing to accept Chocolate back.

Legal Challenges and Possible Outcomes

When asked if Chocolate could avoid deportation by claiming political opposition to the Cuban regime, Novo noted he would need to prove past or potential future torture if returned to the island. "The future outlook for Chocolate isn't very promising," the lawyer emphasized. "With a deportation order, all that's needed is for it to be carried out swiftly," he highlighted.

Although ICE typically doesn't detain individuals for more than 90 days, Novo remarked that some migrants have been held longer. Earlier this month, Chocolate complained about inhumane conditions at his detention facility. He later alarmed fans with a cryptic message: "Soon Jose, Elvis, and El Dany will be joined by Choco," referencing three deceased urban artists.

Current Status and Future Prospects

Recently, Chocolate claimed he had paid his bail and would soon be released, a statement met with skepticism by some fans. In a phone call from jail, shared on Instagram by influencer Un Martí To Durako, Chocolate confidently stated, "I've just paid the bail, I'm ready to go." Following his arrest after days on the run, Chocolate faces multiple charges, including hotel room theft, possession of crack, criminal mischief, written threats of murder, bodily harm, and illegal use of a communication device.
