During his broadcast, Alain claimed that El Funky's criminal record in Cuba relates to common crimes rather than political causes. He asserted that U.S. immigration authorities denied El Funky residency due to his criminal history on the island, which includes a 2017 conviction for possession of prohibited substances.

"The crimes and background of El Funky have nothing to do with politics. He was never imprisoned in Cuba for political reasons," Alain stated. He criticized those defending El Funky as a victim of the Cuban regime, arguing they overlook his criminal record. The YouTuber also questioned human rights organizations and politicians supporting El Funky, suggesting they should focus on defending true Cuban political prisoners instead of individuals with common criminal records.

In his message, he appealed to "Cuban brothers who know his anti-communist trajectory" and U.S. congress members for support during this critical time.

His attorney, Miguel Linda Romero, also commented, affirming his commitment to defending his client. "I will fight for you until the end and never give up. I'm already working on your appeal, and I know we will achieve victory," he expressed.
