South Journal—The defense team of Gerardo Hernandez, one of the five Cubans held in US prisons for 10 years now, will present a Habeas Corpus writ before June 14 so that US justice reconsiders the case.

Hernandez was given two life terms plus 15 years on unproven charges of conspiracy to commit espionage and conspiracy to commit murder.

The Habeas Corpus writ will be submitted to judge Joan Lenard of the Miami Federal Court,the same justice that condemned the five men in what was considered a biased trial back in 2001.

Gerardo Hernandez and Rene Gonzalez (condemned to a 15-year term) were both excluded from a re-sentencing process held in late 2009 in the US city of Miami.

On that occasion, the other three antiterrorist Cubans, Ramon Labañino,Antonio Guerrero and Fernando Gonzalez were given new sentences.

Following their re-sentencing, Labañino, Guerrero and Gonzalez reiterated that they were innocent and expressed that the Cuban Five, as they are known around the world, were punished without any proof. Although three of the sentences were partially reduced, injustice prevails in their case, they pointed out.

They made emphasis on the case of Gerardo Hernandez because the US administration is well aware of the false accusations made against him and the unfair sentence he was given.

The White House admitted that the Cuban Five had not posed any danger to US National Security, and during the re-sentencing process the prosecutor publicly recognized the strong influence of a world movement in support of the release of the five Cubans, who have been in prison since September 12, 1998.

The Cuban Five infiltrated South Florida-based ultra-rightwing organizations that have undertaken terrorist actions against the Cuban people over the past five decades.

The Habeas Corpus writ is based on the injustice being committed against Hernandez, who is serving his sentences in a high security prison in Adelanto,California, and the initiative is expected to cause the judge to reconsider the case and put down at least the two life terms.

The legal procedure is an extraordinary procedure and it provides exceptional possibilities to the accused. (cubadebate)
